These Terms and Conditions (“Terms”) govern your purchase and use of the Drift Pilot mobile application (“Drift Pilot”, “the App”, “we”, “us” or “our”).
By purchasing, downloading, installing or using Drift Pilot, you agree to these Terms. If you do not agree with these Terms, you must not use the App.
Drift Pilot is a software tool designed to assist boat users with:
Drift Pilot is intended solely as an assistance and monitoring aid.
The App must never be used as the sole means of monitoring a vessel, anchor, position, navigation, safety or emergency situation.
The Master, skipper or person responsible for the vessel remains responsible for the safe operation of the vessel and for maintaining an appropriate watch.
Drift Pilot does not replace and must not be relied upon instead of:
Drift Pilot is designed to provide an alert when the configured alarm conditions are detected. However, we do not guarantee that an alarm will always be generated, delivered, heard or received in time.
An alarm may fail, be delayed or be inaccurate because of circumstances including, but not limited to:
The optional telephone-call function is provided solely as an additional convenience and notification feature. It is not an emergency-call system, distress-signalling system or guaranteed emergency notification service.
The App does not guarantee that a telephone call will be initiated, connected, completed, answered or received. The operation of the telephone-call function depends on the user's device, operating system, permissions, mobile network, network coverage, SIM/eSIM, account status and other factors outside our control.
Users must maintain an independent and reliable means of communication appropriate to the circumstances.
Drift Pilot relies on location information supplied by the user's device. GPS and other positioning technologies are inherently subject to limitations and errors.
The position displayed by the App may differ from the vessel's actual position. The accuracy of the anchor-watch alarm, distance, drift, ETA and other calculations depends on the quality and accuracy of the underlying positioning information and other available data.
The user remains responsible for assessing whether the information provided by the App is sufficiently accurate and reliable for the circumstances in which it is being used.
All values displayed by Drift Pilot, including true wind, drift, ETA, distance and similar information, are estimates calculated from available GPS, device sensor and/or user-provided information.
These values may contain errors. They must not be treated as certified measurements, official meteorological information, official navigational information or safety-critical data.
Before relying on Drift Pilot, the user must:
The user is responsible for verifying the App's operation before relying on it.
Mobile phones and other consumer mobile devices are not necessarily designed or certified for continuous operation in marine environments.
The user is solely responsible for protecting the device from water, salt, humidity, heat, cold, vibration, impact and other environmental conditions. The developer accepts no responsibility for damage to the user's device resulting from its use on board a vessel, except where such liability cannot lawfully be excluded.
Drift Pilot is provided as a one-time purchase for the price displayed at the time of purchase. The purchase is not a subscription and does not automatically renew.
The purchase grants you a limited, non-exclusive, non-transferable licence to use the purchased Drift Pilot functionality on compatible devices, subject to these Terms and the applicable terms of Apple App Store or Google Play.
The one-time purchase does not create an obligation on the developer to provide lifetime updates, lifetime technical support or lifetime compatibility with every future device, operating system or third-party platform.
The purchase price relates to the Drift Pilot software and functionality made available at the time of purchase, together with any updates or improvements that the developer may subsequently choose to provide. The purchase does not transfer ownership of the software, source code, intellectual property or any other rights in Drift Pilot to the user.
Nothing in this section limits or excludes any mandatory consumer rights applicable to the purchase.
Purchases made through Apple App Store or Google Play may be subject to the applicable refund procedures of the relevant platform.
Nothing in these Terms limits or excludes any statutory consumer rights that cannot lawfully be limited or excluded. Where applicable consumer law provides rights relating to digital content, including rights concerning conformity, satisfactory quality, fitness for purpose, repair, replacement, price reduction or refund, those rights remain unaffected.
Drift Pilot, including its software, source code, design, interface, graphics, branding, text, algorithms, calculations and other content, is protected by copyright and other intellectual-property laws.
Except where permitted by applicable law, you must not:
We may release updates, improvements, bug fixes or modifications to Drift Pilot. We may add, modify, suspend or discontinue features where reasonably necessary for technical, security, legal, platform, compatibility or operational reasons.
We do not guarantee that Drift Pilot will remain compatible with every future version of iOS, Android, device hardware, operating system or third-party platform indefinitely. We are not required to provide new features, major upgrades or ongoing development indefinitely solely because Drift Pilot was purchased as a one-time purchase.
Where an update is reasonably necessary to remedy a fault or bring the digital content into conformity with applicable statutory consumer rights, we will comply with those rights. Nothing in these Terms limits or excludes any mandatory consumer rights that cannot lawfully be limited or excluded.
We aim to provide a reliable application, but we do not guarantee that Drift Pilot will always be available or operate without errors.
The App may become temporarily unavailable or may not function correctly because of device problems, operating-system changes, platform restrictions, maintenance, updates or circumstances outside our reasonable control.
To the maximum extent permitted by applicable law, we shall not be liable for losses, damage, injury, delay, expense or other consequences arising from or connected with:
The user acknowledges that using a consumer mobile application as an anchor-monitoring aid involves inherent risks and that responsibility for the safe operation of the vessel and the safety of persons on board remains with the Master, skipper or person responsible for the vessel.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with Drift Pilot shall not exceed the amount actually paid by you for Drift Pilot during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for anything that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence where such exclusion or limitation is prohibited by law, or any mandatory statutory consumer rights.
Information provided by Drift Pilot does not constitute professional navigation, seamanship, meteorological, engineering or safety advice. The user must exercise independent judgement and comply with applicable laws, regulations, maritime procedures, vessel requirements and the vessel's safety-management system.
To the maximum extent permitted by applicable law, you agree to compensate the developer for reasonable losses, liabilities, costs and expenses arising directly from:
This indemnity does not apply to the extent that a claim or loss results from the developer's negligence, wilful misconduct or breach of applicable law.
You must use Drift Pilot only for lawful purposes. You must not use the App in a way that violates applicable maritime, telecommunications, privacy or other laws or regulations.
Drift Pilot may be distributed through third-party platforms, including Apple App Store and Google Play. Those platforms have their own terms, policies and technical requirements.
The developer is not responsible for the independent operation, availability, policies or decisions of those platforms. Your relationship with Apple or Google in connection with the purchase may also be governed by their respective terms.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it lawful and enforceable where possible. The remaining provisions shall continue in effect to the maximum extent permitted by law.
These Terms, together with the Privacy Policy and any additional terms presented within Drift Pilot, constitute the agreement concerning your use of the App, subject to any mandatory rights provided by applicable law.
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales, except to the extent that mandatory consumer protection laws applicable in your country of residence provide otherwise.
Nothing in these Terms prevents you from relying on mandatory consumer rights or protections available to you under the laws applicable to you.
Where a dispute cannot be resolved informally, it may be brought before a court having appropriate jurisdiction under applicable law. Nothing in these Terms is intended to deprive a consumer of any mandatory right to bring proceedings in the courts available to them under applicable law.
